Legal compliance for plastics recycling under current REACH and Waste legislation – Guidance and position paper on the basis of practical recycling examples

The project pursued two central objectives: On the one hand, plastics recyclers and other stakeholders in the value chains were to receive further concrete assistance for handling material flows containing substances that fall under the authorisation and/or restriction regime or that are regulated for other reasons in the regulatory systems of chemicals and waste policy. On the other hand, a common understanding of the industry players and the relevant German authorities regarding the (interpretation of the) legal framework was to be worked towards in order to contribute to standardised nationwide enforcement on this basis and, in addition, possibly to achieve a uniform (technical) positioning in further debates at EU level. In order to achieve these goals, a practical guide for companies and waste owners (craftsmen, demolition companies, etc.) was developed, specific practical examples of the effects of different legal interpretations on the stakeholders involved (recycling companies, recyclate purchasers and competent authorities) were drawn up and a position paper on the interpretation of the legal framework and the end-of-waste criteria for the plastic material stream was written.
