Investigation on the legal consequences of classification and labelling according to Regulation (EC) No. 1272/2008 on the classification, labelling and packaging of substances and mixtures (CLP) in the frame of an update and a partial revision of legal acts contained in a database with the name „legal consequences of classification“

In November 2015, the Federal Institute for Occupational Safety and Health (BAuA) published the results of a legal opinion of the Federal Ministry of Labor and Social Affairs entitled “Legal consequences of German and European law from the classification of substances and mixtures under Regulation (EC) No. 1272/2008 and from the classification of substances and preparations in accordance with Directives 1999/45/ EC and 67/548/EEC” on its website.

The central result of this opinion was a two-part database. The first part of the database (Part A) contained 19 legal norms which, at the time of the opinion, contained a reference to the classifications of the CLP Regulation. The second, larger part contained 26 researched legal norms which still contained references to the classification system before CLP (Part B).

With the aim of updating the database and extending it to other legal consequences of classification valid in Germany, the BAuA commissioned the Institute for Ecology and Politics – Ökopol GmbH to perform the necessary research and preparation work on 29 November, 2018.

The research shows that between 2015 and 2019 43 out of 45 audited norms (database A + B) have been given a new version. Some standards have been changed several times within this time period.  

These norms were examined for content changes. If necessary, the entries in the database were updated.

In addition to the update of the database’s existing entries a further research identified additional norms which were not previously included in any of the two parts of the database. A total of 65 additional regulations were examined in detail. As a result of this review, database Part A has been expanded to include eleven new entries.
